Terms of Service — Ideal Home Health

1. Acceptance of Terms

Welcome to idealhealthpartners.com/massachusetts (the “Site”), operated by Ideal Home Health Care (“Ideal Home Health,” “we,” “us,” or “our”). By accessing or using the Site, or by using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site or our services.

2. About Our Services

Ideal Home Health is a Medicare-certified skilled home health agency providing clinical services — including skilled nursing, physical therapy, occupational therapy, speech-language pathology, home health aide services, and care coordination — to patients in Massachusetts, delivered pursuant to a physician’s order and plan of care.

3. Eligibility and No Guarantee of Coverage

Coverage for services is determined by Medicare, Medicare Advantage plans, or other applicable payers based on the patient’s specific plan and eligibility, not guaranteed by Ideal Home Health. Eligibility for any program referenced on this Site is determined solely by the applicable state agency or payer. Nothing on this Site, and nothing communicated by our staff, constitutes a guarantee of eligibility, enrollment, approval, or payment.

4. Relationship of the Parties

Clinical staff providing services on behalf of Ideal Home Health are employed or contracted directly by Ideal Home Health Care and act under its clinical supervision, unlike the consumer-directed caregiver model used in other states served by the Ideal Health Partners network.

5. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to misuse the Site, attempt unauthorized access to any systems, or submit false or misleading information through any form on the Site.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of Ideal Home Health Care or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, available at idealhealthpartners.com/massachusetts/privacy-policy/, which is incorporated into these Terms by reference.

8. Disclaimers

THE SITE AND ALL INFORMATION PROVIDED ON IT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IDEAL HOME HEALTH CARE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY PROFESSIONAL NEGLIGENCE IN THE PROVISION OF CARE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless Ideal Home Health Care, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.

11. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.

12. Dispute Resolution — Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, their breach, termination, enforcement, interpretation, or validity, or your use of the Site, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, seated in Hampden County, Massachusetts, rather than in court. This does not apply to (a) either party’s right to bring an individual claim in small claims court, or (b) either party’s right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

YOU AND IDEAL HOME HEALTH AGREE THAT ANY ARBITRATION WILL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. Changes to These Terms

We may update these Terms from time to time. The Effective Date below reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
